Box 1369 Arecibo, P.R. 00613 Cupeyoc gmail.com 787-650-3558 14 October 2026 VIA CERTIFIED MAIL - RETURN RECEIPT REQUESTED Certified Mail Receipt No: 7022 2410 0001 8578 8555 ALSO FILED VIA ELECTRONIC REGISTRY (comentarios@jrsp.pr.gov) Puerto Rico Energy Bureau (NEBR I NEPR) Attn: Clerk's Office ¡ Compliance Division World Plaza Building 268 Muñoz Rivera Ave., Suite 202 San Juan, PR 00918 « I fl ryfl U /u Secretaría Negociado de Energía /2 .3Óji Re: OPEN LETTER I FORMAL COMPLAINT: Gross Operational Negligence by LUMA Energy Regarding Abandoned, Collapsing Infrastructure (Pole Asset #995 and Decommissioned Wood Pole) To the Honorable Commissioners of the Puerto Rico Energy Bureau, I am writing this Open Letter to formally register a severe safety complaint against LUMA Energy, LLC, and to request immediate regulatory intervention under the Bureau's oversight authority. LUMA Energy is currently maintaining a state of gross operational negligence by failing to remove structurally compromised, decommissioned assets that pose an imminent physical threat to public safety. Despite prior written notices sent via Certified Mail to LUMA Energy's General Counsel, the utility provider has completely ignored these critical hazards, which are located precisely at: Calle Roberto Berrios, Carretera 681, KM 6.5, Bo. Islote, Sect. Boan, Arecibo, P.R. 00612. The Core Violations and Public Safety Hazards Include: ¯ Abandoned Grid Infrastructure (Cement Pole #995): LUMA Energy crews previously replaced a concrete utility pole at this specific location with a new one. However, rather than fully extracting and disposing of the old asset, they abandoned the useless cement pole (LUMA Asset Pole #995) in the public right-of-way. Over time, its structural integrity has completely failed; it is severely degraded, compromised, and about to fall to the ground. ¯ Live Hanging Fixture Hazard: A street light fixture is currently detached and hanging dangerously from this failing, abandoned cement pole over an area traveled by pedestrians and motorists.

Page 2

¯ Abandoned Rotted Wood Pole: In addition to the cement pole, there is an adjacent decommissioned wood utility pole that was also abandoned by the utility company at this same location. This wood pole is severely rotted and structurally unstable. It no longer serves any functional grid or utility purpose and is now used solely as an unauthorized backdrop for advertisement signs by different local companies, compounding the blight and safety risk in the right-of-way. ¯ Failure to Properly Relocate Street Lighting: LUMA Energy failed to complete the modernization process at this site. While the active electric cables were moved over to the newly installed concrete utility pole, the street light fixture was left behind on the crumbling asset rather than being replaced or re-installed onto the active infrastructure. Respectfully submitted, ¯ Failure to Respond to Actual Notice: LUMA Energy has been provided with clear, actual notice of these specific hazards, alongside multiple photographic exhibits detailing the danger. They have failed to dispatch emergency crews, issue an expedited work order, or mitigate the risks. As the independent regulator of Puerto Rico's electrical system, the Energy Bureau is responsible for ensuring that LUMA Energy operates the transmission and distribution grid in a manner that prioritizes public safety, efficiency, and compliance with structural standards. Leaving crumbling concrete "stub" poles and rotted wood poles standing in public spaces after modernizing a line violates basic utility safety codes and constitutes a direct liability to the lives and property of Puerto Rican residents. This open letter serves as a formal request for the Bureau to: 1. Order LUMA Energy to immediately dispatch an emergency crew to extract and remove both the abandoned, collapsing cement Pole #995 and the abandoned, rotted wood pole. 2. Order LUMA Energy to install a functioning, new street light fixture onto the new cement pole that currently holds the active electric cables, restoring safe illumination to Calle Roberto Berrios. 3. Open an investigation or compliance file regarding LUMA's systemic practice of abandoning structurally compromised, decommissioned assets across municipalities after line replacements. Attached to this letter is a copy of the urgent supplement notice sent to LUMA's General Counsel, alongside the photographic exhibits documenting the imminent danger. I appreciate your prompt regulatory enforcement before a preventable tragedy occurs. Mi uel' Andino S is Enclos

Tracking Number 7019297000020ê556568. To date, I have not received a formal response nor has any corrective action been taken regarding the safety hazard detailed in that notice. As previously stated, there are severely rotted, structuraly compromised, and abandoned electric poles located at Calle Roberto Berrios Carretera 681 KM 6.5, Bo Islote, Sect Boan, Arecibo, PR 0ê612. These poles are no longer serving a functional utility purpose but pose an inmediate, severely physical threat to the surrounding public, property, and passing motorist. Because LUMA Energy operates and manages the transmision and distribution system infrastructure across Puerto Rico, your office maintains legal responsability for mitigating infrastructure hazards, grid maintenance, and the safe removal of decommissioned equipment. Leaving heavily degrated or unstable poles upright in a public right-of-way constitutes severe structural negligence. Should any of

these poles collapse and cause property damage, personal injury, or a fatal accident, this correspondence -alongside my previous notice -will serve as clear evidence that LUMA Energy had actual, written knowledge of the hazard and failed to act. Thank you for your prompt legal and operational attention to this matter. I expect a swift resolution before preventable damage or injury occur. Sincerely, 4-guel A.\Andino Soils CC: P tthoJRico Energy B eau (NEBR)
